One publisher has a profit-sharing arrangement with the author. Typically, this type of arrangement is a requirement for obtaining a copyright license, but it does not mean that the work is not under copyright. Whoever controls copyrights still will have to obtain a license to publish the work.

In 1934, Congress amended the copyright act (1918) to provide that terms of copyright, including renewal, would be determined by registration.16 The amendments also had the effect of retroactively extending the existing copyright term of 28 years.17 Until these amendments, a copyright had to exist when the work was created in order to protect it against subsequent copying. The registration requirement afforded copyright protection from the time of registration. However, registration is no longer required to protect the copyright. One copyright owner can protect a work in some amount of time even without registration.18

If no copyrightable material is used in doing so, this would not create a problem. However, photocopying results in the creation of a new work. The copyright owner of the original copy is the owner of the new work, regardless of any separate licenses since it is not a derivative work. Any additional copying is in breach of the license for the original work and could subject you to legal action.18

In 1992, Congress passed the Cable Communications Policy Act (CCPA). This act extended the exclusive right to cable operators to all works “consisting of a series of related events, such as the premiere date of a motion picture, drama, or musical production.”19 The Cable Act essentially started a rewriting of the cable code of the 1909 Copyright Act, creating a new copyright scheme applicable to cable and satellite television programming and the transmission of such programs over the Internet.
